97. Whether minor mistakes in the discharge of duties can be brought under contributory negligence factors?

The disciplinary authorities take all factors in to account before they intimate formal disciplinary proceedings. No authority would take an official to task on the basis of purely clerical mistakes if it had happened due to rush of work. In cases where the mistakes exhibit a gross negligence which could have been avoided, the competent authorities will have to take due notice.

98. Whether pecuniary responsibility will be fixed on routine nature?

Pecuniary responsibility need not be fixed for mere routine at pretty lapses. For effecting recovery, negligency should be such as has been the direct or prominent cause of the loss to the Govt. and loss sustained was a probable consequence of that lapse.

99. If any article is stolen or lost, Whether the depreciated value or the real value to be recovered from the subsidiary offenders?

The depreciated value of the stores may be calculated by applying the 20% depreciation in the case of vehicles, including cycles, and 15% in the case of calculating machines, on the reduced balance every year.  The amount to be recovered may be limited to the Government servant capacity to pay.

100. What is the guidelines for recovering loss in case of fraud cases?

If the loss has occurred through fraud, every endeavour should be made to recover the whole amount lost from the guilty persons, and if laxity of supervision has facilitated the fraud, the supervising officer at fault may properly be penalised either directly by requiring him to make good in money a sufficient proportion of the loss or indirectly by reduction or stopping of his increment of pay.
