Clarification on payment of combined duty allowance

• The Central Administrative Tribunal (CAT), Ernakulam, in Original Application (OA) 391/2021, ruled that Combined Duty Allowance (CDA) can be claimed only if there are two or more posts sanctioned in the establishment.
• The duty of one post must be combined with another post within that particular office.
• The CAT directed the recovery of excess Combined Duty Allowance payments made to Gramin Dak Sevaks (GDS) in both single-handed and other Branch Offices (BOs).
• However, the Department issued orders on 1.2.2022 granting Combined Duty Allowance to single-handed Branch Offices, considering the specific nature of their duties. Therefore, recovery of this allowance is not necessary, and its continuation should be permitted.
• The Karnataka and Telangana postal circles issued clarifications regarding the grant of Combined Duty Allowance in double-handed Branch Offices. In these clarifications, CDA was allowed irrespective of whether the vacant post was sanctioned in the same establishment or elsewhere, which contradicts the provisions of the orders dated 25.6.2018.
• As per the orders dated 25.6.2018, it is necessary that two or more posts should be sanctioned within the same establishment, meaning within the same Branch Office only.
• Therefore, the orders issued by the Karnataka and Telangana circles need to be withdrawn immediately, and the excess Combined Duty Allowance payments made in contravention of the rules should be recovered in three installments. (DG (P) No. 19-13/2022-GDS dated 31.7.2023)

• மத்திய நிர்வாக தீர்ப்பாயம் (CAT), எர்ணாகுளம், அசல் விண்ணப்பம் (OA) 391/2021 இல், ஒரு ஸ்தாபனத்தில் இரண்டு அல்லது அதற்கு மேற்பட்ட பதவிகள் அனுமதிக்கப்பட்டிருந்தால் மட்டுமே ஒருங்கிணைந்த பணிப்படி (CDA) கோர முடியும் என்று தீர்ப்பளித்தது.
• ஒரு பதவியின் கடமை அந்த குறிப்பிட்ட அலுவலகத்தின் மற்றொரு பதவியுடன் இணைக்கப்பட வேண்டும்.
• ஒரு கையால் மற்றும் பிற கிளை அலுவலகங்களில் (BOக்கள்) பணிபுரியும் கிராமின் டாக் சேவகர்களுக்கு (GDS) வழங்கப்பட்ட அதிகப்படியான ஒருங்கிணைந்த பணிப்படி தொகையை திரும்ப வசூலிக்க CAT உத்தரவிட்டது.
• இருப்பினும், துறையானது 1.2.2022 அன்று ஒரு கையால் இயங்கும் கிளை அலுவலகங்களுக்கு அவர்களின் குறிப்பிட்ட கடமைகளின் தன்மையைக் கருத்தில் கொண்டு ஒருங்கிணைந்த பணிப்படியை அனுமதித்து உத்தரவுகளை வெளியிட்டது. எனவே, இந்த படியை திரும்பப் பெறுவது அவசியமில்லை, மேலும் அதன் தொடர்ச்சி அனுமதிக்கப்பட வேண்டும்.
• கர்நாடகா மற்றும் தெலுங்கானா தபால் வட்டங்கள் இரட்டை கையால் இயங்கும் கிளை அலுவலகங்களில் ஒருங்கிணைந்த பணிப்படி வழங்குவது தொடர்பாக தெளிவுபடுத்தல்களை வெளியிட்டன. இந்த தெளிவுபடுத்தல்களில், காலியாக உள்ள பதவி அதே ஸ்தாபனத்தில் அனுமதிக்கப்பட்டிருந்தாலும் இல்லாவிட்டாலும் CDA அனுமதிக்கப்பட்டது, இது 25.6.2018 தேதியிட்ட உத்தரவுகளின் விதிகளுக்கு முரணானது.
• 25.6.2018 தேதியிட்ட உத்தரவுகளின்படி, இரண்டு அல்லது அதற்கு மேற்பட்ட பதவிகள் ஒரே ஸ்தாபனத்தில், அதாவது அதே கிளை அலுவலகத்தில் மட்டுமே அனுமதிக்கப்பட வேண்டும்.
• எனவே, கர்நாடகா மற்றும் தெலுங்கானா வட்டங்களால் வெளியிடப்பட்ட உத்தரவுகள் உடனடியாக திரும்பப் பெறப்பட வேண்டும், மேலும் விதிகளுக்கு முரணாக வழங்கப்பட்ட அதிகப்படியான ஒருங்கிணைந்த பணிப்படி தொகைகள் மூன்று தவணைகளில் திரும்ப வசூலிக்கப்பட வேண்டும். (DG (P) No. 19-13/2022-GDS dated 31.7.2023)
