Model Representation 50. Draft for withdrawing FIR filed in a misappropriation case

 A police case for the misappropriation held 10 years back of Rs.3000 was filed by the SPOs. The following draft was sent in this case.

"I was subjected to a Rule-14 memorandum, and the appellate authority initially imposed a punishment of removal from service. Subsequently, I am deeply grateful to the DPS for considering my appeal and reducing the punishment, as per order No. …………, dated ……., thereby granting me the opportunity to continue serving in the department.

However, the Superintendent of Post Offices ………., has now filed a police complaint against me, alleging misappropriation of ₹3,000, related to the same case for which I was already punished under the aforementioned order. 

This action directly contravenes Directorate Order No. 8-1/Rulings/2014-INV(Part), dated November 8, 2017, which stipulates that police complaints are only warranted for losses and frauds exceeding ₹50,000. Despite this, the SPO, ……………, filed a police complaint, resulting in FIR No. ……… dated ………, at ……….. Police Station.

I have already endured significant mental anguish, financial hardship, and service-related losses due to the initial disciplinary action. Filing a subsequent police complaint for the same matter, involving a relatively small amount, constitutes double jeopardy and severely jeopardizes not only my livelihood but also the well-being of my entire family. This action is fundamentally unjust and violates existing Directorate orders.

Therefore, I respectfully request your kind intervention to direct the SPO, …………….., to withdraw the police complaint registered against me."
