 If promotion offer is refused, whether he is eligible to appear the LDCE examination?
According to DG (P) No. W-17/10/2023-SPN -I _DOP dated 6.3.2023, if an official refuses a promotion, the following guidelines apply regarding their eligibility to appear in a Limited Departmental Competitive Examination (LDCE):

• As per the orders dated 1.10.1981, an official who refuses a promotion is ineligible for further promotion for one year from the date of refusal.
• However, despite this one-year ban on promotion, the official is allowed to appear for the LDCE for the next vacancy year.
• The offer of promotion, if successful in the LDCE, shall not be issued until the completion of one year from the date the initial promotion was refused.
• The declared list of successful LDCE candidates should explicitly mention this condition.
In essence, while the refusal of a promotion incurs a one-year ban on further promotion, it does not prevent the official from taking the LDCE. However, the one year ban will be applied to any promotion earned from the LDCE.

• 1.10.1981 தேதியிட்ட உத்தரவுகளின்படி, பதவி உயர்வை மறுக்கும் அதிகாரி, மறுத்த தேதியிலிருந்து ஒரு வருடத்திற்கு மேலும் பதவி உயர்வுக்கு தகுதியற்றவர்.
• இருப்பினும், பதவி உயர்வுக்கான இந்த ஒரு வருட தடை இருந்தபோதிலும், அடுத்த காலியிட ஆண்டிற்கான LDCE தேர்வில் கலந்து கொள்ள அதிகாரி அனுமதிக்கப்படுகிறார்.
• LDCE இல் வெற்றி பெற்றால், பதவி உயர்வு மறுக்கப்பட்ட தேதியிலிருந்து ஒரு வருடம் முடிந்த பின்னரே பதவி உயர்வுக்கான சலுகை வழங்கப்படும்.
• வெற்றி பெற்ற LDCE விண்ணப்பதாரர்களின் அறிவிக்கப்பட்ட பட்டியலில் இந்த நிபந்தனை வெளிப்படையாகக் குறிப்பிடப்பட வேண்டும்.
சுருக்கமாக, பதவி உயர்வை மறுப்பது மேலும் பதவி உயர்வுக்கான ஒரு வருடத் தடையை ஏற்படுத்தினாலும், அதிகாரி LDCE தேர்வில் கலந்து கொள்வதைத் தடுக்காது. இருப்பினும், LDCE இலிருந்து பெறப்பட்ட எந்தவொரு பதவி உயர்வுக்கும் ஒரு வருடத் தடை விதிக்கப்படும்.
