63. Whether past bad records can be recorded while deciding the penalty
• If past bad records or punishments are to be considered when determining a penalty, they must be specifically mentioned as a charge in the charge sheet itself.
• If the past record is not mentioned in the charge sheet, then any mention of it in the penalty order will invalidate the entire proceedings.
• Such proceedings should be avoided.
• This is based on MHA OM No. 134/20/68-AVD dated 28.8.1968.
• ஒரு தண்டனையைத் தீர்மானிக்கும்போது, முந்தைய மோசமான பதிவுகள் அல்லது தண்டனைகள் கருத்தில் கொள்ளப்பட வேண்டுமானால், அவை குற்றப்பத்திரிகையில் ஒரு குறிப்பிட்ட குற்றச்சாட்டாகக் குறிப்பிடப்பட வேண்டும்.
• குற்றப்பத்திரிகையில் முந்தைய பதிவு குறிப்பிடப்படவில்லை என்றால், தண்டனை உத்தரவில் அதைப் பற்றிய எந்தவொரு குறிப்பும் முழு நடவடிக்கைகளையும் செல்லாததாக்கும்.
• இத்தகைய நடவடிக்கைகள் தவிர்க்கப்பட வேண்டும்.
• இது MHA OM எண். 134/20/68-AVD, தேதி 28.8.1968 ஐ அடிப்படையாகக் கொண்டது.
