237. Recording of Defence evidence

After the recording of evidence on behalf of the presenting officer is over, the inquiry officer shall require the charged officer to submit his statement of defence. In case of oral statement, it shall be recorded and his signatures obtained thereon. A copy of the defence statement shall be made available to the presenting officer.

Thereafter, the inquiry officer shall proceed to record the defence evidence. He would, first, take on record the defence documents which had been found relevant and allowed by him. These documents will also be marked for easy reference, such as D1, D2, ... The charged officer, as well as the presenting officer would be allowed inspection of such documents, if it has not been done before.

The defence witnesses shall then be examined by the same procedure as was adopted for examining the official witnesses. If the charged officer opts to examine himself, he shall be examined like any other witness and cross-examined by the presenting officer. Except in such a case, the presenting officer has no scope of asking any question from him.
