Ø  In accordance with DOPT OM no.20011/5/90-Estt(D) dated 04.11.1992, it is crystal clear as per Para (3) that seniority of a person regularly appointed to a post should be determined by the order of merit indicated at the time of initial appointment.

Ø  The said reservation roster/points are meant only for identifying the vacancy that goes to a particular category of officer and in no way acts as a determinant for fixation of seniority of the officer”

Ø  Hence, community under which employee is selected has nothing to do with in deciding position in DGL and it is that the merit marks that decides the seniority

Ø  In accordance with Para 3 A (iii) of Transfer policy guidelines circulated vide F.No.141-141/2013-SPB-II dated 17.01.2019 , it is crystal clear that seniority of a person transferred inward under rule 38 of Postal Manual Volume IV by means of mutual exchange would have been assigned to him had he been originally recruited in that unit of the place vacated by the official with whom he exchanges appointment, which is the lower.

Ø  As postulated in DOPT OM no. 22011/7/86-Estt (D) dated 03.07.1986, since the recruitment of Postal Assistant for the previous year is 50%(now 60%) by Direct Recruitment and 50% (40%) by LDCE, seniority should be fixed as DP,DR,DP,DR like wise.

Ø  Inter-se seniority between promotees and Direct Recruits was not maintained in many division.

Ø  Candidates selected under RRR ( Compassionate ground) are to be placed according to date of joining  below all Direct recruits. DOPT OM no.14014/02/2012 Estt.(D) dated 30.05.2013

Ø  In respect of Direct recruits, in case of tie in marks/DOJ seniority should be fixed based on DOB.If DOB also same according to alphaphetical order.

Ø  In case of department promottees, in case of tie in marks according to feeder cadre seniority. If the DOJ in feeder cadre is same then according to DOB. If DOB also same then according to alphabetical order.
