160. Whether any excess payment of pay and allowances can be recovered from the pension?
No. There is no provision to recover the excess pay and allowances from the pensioners vide GID (7) below Rule 73 of CCS (Pension) Rules, 1972. It is most pertinent to note that once the pension is authorized, it should not be revised to the disadvantage of the pensioner as per Rule 70 of the Pension Rules 1972.
161. When an employee committed suicide while in service will the family entitled for family pension and other retirement benefits?
There is no distinction between suicide and natural death. The family is entitled for family pension and other benefits.
162. What are all the types of cases entrusted to the C.B.I?
Allegations against a Govt. Servant involving offences under the prevention of Corruption Act 1988 like bribery, cheating, criminal breach of trust, corruption, falsification of records etc.
(ii) Possession of assets beyond his known sources of income.
(iii) Allegations which involve inquiries from non official persons or non government records and
(iv) Cases of complicated nature which call for expert investigation.
The Govt. may refer any other cases. Once a case is referred to CBI, departmental, investigations may not be undertaken in the said matter.
