Changes in the procedure in promotion in the case of candidates against whom disciplinary action is pending

• The Department of Posts, via its letters dated 12.4.2022 & 10.11.2022, had applied the procedure applicable in the case of Departmental Promotion Committee (DPC) for promotion to competitive exams for promotion, even for candidates against whom disciplinary or criminal proceedings were pending.
• Due to this earlier procedure, even if a qualified candidate was awarded a minor penalty like censure after the declaration of results, their promotion was forfeited.
• We had earlier made a detailed video on this issue in our channel and insisted on reverting back this incorrect order.
• The Department of Posts (DOP), through its letter dated 17.5.2023, reconsidered both the previous orders and revised the procedure. Accordingly:
• All eligible candidates, including Government servants under suspension or facing pending disciplinary or criminal charges, shall be allowed to appear in the competitive exams.
• The results of candidates under suspension or those against whom a charge sheet has been issued and a disciplinary or criminal case is pending will be kept in a sealed cover.
• After the conclusion of the disciplinary case, if the candidate is fully exonerated, the results in the sealed cover shall be declared. If found guilty in a criminal prosecution, the sealed cover need not be opened.
• If any penalty is in effect on the date of declaration of results, and if it is censure, the results shall be declared. In the case of withholding of promotion, the promotion shall be accorded after the end of the punishment period.
• If no specific period of punishment is mentioned, the promotion should be accorded after three years.
• In cases of recovery of pay as a penalty, the results shall be declared.
• For other minor penalties like reduction to a lower stage or withholding of increments of pay, the promotion can be given after the end of the punishment period.
• For the major penalty of reduction to a lower stage for a specified period, promotion will be effective after the conclusion of the punishment.
• In the case of the major penalty of reduction to a lower stage, grade, or post, the results need not be declared.
• For candidates under suspension, their results shall continue to be in the sealed cover until the conclusion of the proceedings. If it is decided not to initiate disciplinary action, the result shall be declared.
• These revised instructions have come into effect from 17.5.2023. Past cases need not be reopened.
• It is a clear injustice to those affected in the period between 12.4.2022 and 16.5.2023. This issue should be taken up with the Department.

• இடைநீக்கத்தில் உள்ள அல்லது ஒழுங்கு நடவடிக்கை அல்லது கிரிமினல் குற்றச்சாட்டுகள் நிலுவையில் உள்ள அரசு ஊழியர்கள் உட்பட அனைத்து தகுதியான விண்ணப்பதாரர்களும் போட்டித் தேர்வுகளில் அனுமதிக்கப்படுவார்கள்.
• இடைநீக்கத்தில் உள்ள அல்லது குற்றப்பத்திரிகை தாக்கல் செய்யப்பட்டு ஒழுங்கு நடவடிக்கை அல்லது கிரிமினல் வழக்கு நிலுவையில் உள்ள விண்ணப்பதாரர்களின் முடிவுகள் சீல் வைக்கப்பட்ட உறையில் வைக்கப்படும்.
• ஒழுங்கு நடவடிக்கை முடிவுக்கு வந்த பிறகு, விண்ணப்பதாரர் முழுமையாக விடுவிக்கப்பட்டால், சீல் வைக்கப்பட்ட உறையில் உள்ள முடிவுகள் அறிவிக்கப்படும். கிரிமினல் வழக்கில் குற்றவாளி என நிரூபிக்கப்பட்டால், சீல் வைக்கப்பட்ட உறையை திறக்க வேண்டியதில்லை.
• தேர்வு முடிவுகள் அறிவிக்கப்படும் தேதியில் ஏதேனும் தண்டனை அமலில் இருந்தால், அது கண்டனமாக இருந்தால், முடிவுகள் அறிவிக்கப்படும். பதவி உயர்வு நிறுத்தி வைக்கப்பட்டிருந்தால், தண்டனை காலம் முடிந்த பின்னரே பதவி உயர்வு வழங்கப்படும்.
• குறிப்பிட்ட தண்டனை காலம் எதுவும் குறிப்பிடப்படவில்லை என்றால், மூன்று ஆண்டுகளுக்குப் பிறகு பதவி உயர்வு வழங்கப்பட வேண்டும்.
• ஊதியத்தை திரும்பப் பெறுதல் போன்ற தண்டனைகளில், முடிவுகள் அறிவிக்கப்படும்.
• சிறிய தண்டனைகளின் கீழ் ஒரு தாழ்வான நிலைக்கு குறைத்தல் அல்லது ஊதிய உயர்வுகளை நிறுத்தி வைத்தல் போன்ற பிற தண்டனைகளுக்கு, தண்டனை காலம் முடிந்த பிறகு பதவி உயர்வு வழங்கப்படலாம்.
• ஒரு குறிப்பிட்ட காலத்திற்கு ஒரு தாழ்வான நிலைக்கு குறைத்தல் போன்ற பெரிய தண்டனைக்கு, தண்டனை முடிந்த பின்னரே பதவி உயர்வு செயல்பாட்டுக்கு வரும்.
• தாழ்வான நிலை, தரம் அல்லது பதவிக்கு குறைத்தல் போன்ற பெரிய தண்டனைக்கு, முடிவுகள் அறிவிக்கப்பட வேண்டியதில்லை.
• இடைநீக்கத்தில் உள்ள விண்ணப்பதாரர்களுக்கு, நடவடிக்கைகள் முடிவடையும் வரை அவர்களின் முடிவுகள் சீல் வைக்கப்பட்ட உறையில் தொடரும். ஒழுங்கு நடவடிக்கை எடுக்க வேண்டாம் என்று முடிவு செய்யப்பட்டால், முடிவு அறிவிக்கப்படும்.
• இந்த திருத்தப்பட்ட அறிவுறுத்தல்கள் 17.5.2023 முதல் நடைமுறைக்கு வந்துள்ளன. கடந்த கால வழக்குகள் மீண்டும் திறக்கப்பட வேண்டியதில்லை.
• 12.4.2022 முதல் 16.5.2023 வரையிலான காலகட்டத்தில் பாதிக்கப்பட்டவர்களுக்கு இது ஒரு தெளிவான அநீதியாகும். இந்த விஷயம் துறையிடம் கொண்டு செல்லப்பட வேண்டும்.
