Stop Harassing Staff on Contributory Factors for Simple and Flimsy Reasons
It has come to our attention that staff members are being harassed and held accountable for contributory negligence based on simple or flimsy reasons. This practice is a misuse of the provisions related to ‘unbecoming of a Government Servant’ and deviates from the ruling contained in Volume III, FHB, and other relevant guidelines.
The Directorate guidelines issued in letters No. 6/8/59-Disc dt. 9.7.1959, 25/49/60-Disc dt.30.11.60, and 15-9/74-1NV dt. 10.2.75, along with subsequent orders, are being violated. Officials are being penalized under the contributory negligence factor, resulting in unwarranted recoveries for minor or honest errors.
The provisions contained in Rules 106, 107, 108, and 111 of Postal Volume III, as well as Rule 204A (1) in Volume II, and Rule 58, Appendix 4 of F.H.B. Volume I, have been ignored in the handling of such cases. These rules clearly state that honest errors can be condoned, and the financial circumstances of an officer should be considered when determining pecuniary liability, as excessive recoveries can impair future efficiency.
The Department should issue proper guidelines on contributory negligence to prevent harassment of officials for simple mistakes. The practice of holding staff accountable for such errors without considering the context or the guidelines should be stopped immediately.
