MACP Anomalies – Injustice to Promotees under MACP Scheme
The MACP (Modified Assured Career Progression) scheme is being applied in a manner that causes injustice to promotees, particularly regarding the counting of stagnation for the purpose of MACP. In the case of OA No. 382/2011, OA 353/2011, and OA 354/2011 filed before the Central Administrative Tribunal (CAT), Jodhpur, the tribunal ruled that previous career advancements should not be treated as promotions for the purpose of MACP. The tribunal directed that the counting of stagnation should begin afresh from the promotion to the PA post and further ordered the repayment of amounts with the due GPF interest.
Additionally, in the Sivakumar case, the Supreme Court upheld the entitlement of a third MACP for an official, despite being a promotee. The Court ruled that the third MACP should be granted, and this principle must apply to all similarly situated individuals.
In light of these legal decisions, the Department of Posts should extend similar relief to all promotees, ensuring that previous career advancements are not considered as promotions for the purpose of MACP, and that all eligible officials are granted their rightful MACP entitlements.
