The pension amount is calculated as 50% of the last drawn or average emoluments, whichever is more beneficial. However, an exception is made for government servants who retire on invalidation before completing ten years of service.
In such cases, they are still eligible for an invalid pension, and the minimum qualifying service requirement of ten years is waived. Furthermore, when calculating the length of service, a fraction of a year equal to three months or more is treated as a completed six months.
This means that a government servant with nine years and nine months of service would be eligible for pension.
This clarification is based on the Department of Pension & Pensioners' Welfare (DOP&PW) Office Memorandum No. 38/01(5)/2022 P & PW (A) dated 26.10.2022.
