36. Model Representation - Third MACP not granted after completion of 20 years service in PA cadre

 Even though the official has completed 20 years of service in PA cadre, the third MACP was not accorded on the plea that he should complete 10 years from 1.9.2008. This was challenged and the official got his dues. There may be some cases like this. Please check if any.

Respected Sir,

With due respect, I humbly submit the following for your kind consideration and immediate action.

I was appointed as a Postman on 11.01.1992 after being promoted from the GDS cadre. Subsequently, I was promoted to the position of Postal Assistant with effect from 29.03.1997. As per the MACP (Modified Assured Career Progression) Scheme, I became eligible for the third MACP after completing 20 years of service in the Postal Assistant cadre. Therefore, I am due for my third financial upgradation with effect from April 2017, excluding periods of EXOL (Extraordinary Leave) and Dies non, which are not countable for service.

As per the DoPT OM No. 35034/3/2008-Estt (D) dated 19.05.2009, particularly para 20, which outlines the conditions for MACP entitlement, I have fulfilled the requirements for the third financial upgradation in April 2017 after 20 years of service in the Postal Assistant cadre. Despite meeting all eligibility criteria, my case has not yet been processed, and the financial upgradation due to me has not been granted.

It seems that the delay is based on a misunderstanding that, since I received my second MACP with effect from 01.09.2008, my third MACP can only be granted after 10 years from that date. However, this interpretation is incorrect. At the time of implementation of the second MACP, I had already completed 11 years of service as a Postal Assistant. After completing a total of 20 years in the Postal Assistant cadre, I became eligible for the third MACP in April 2017, irrespective of the date of the second MACP.

The presumption made by the Divisional Office regarding the timeline for my third MACP is not aligned with the provisions outlined in the aforementioned DoPT letter. Upon completion of 20 years of service in the Postal Assistant cadre, I am entitled to the next financial upgradation without any further delay.

I, therefore, request that you kindly expedite the processing of my case and ensure that the Departmental Screening Committee (DPC) considers and approves my third MACP financial upgradation with effect from April 2017. A prompt resolution would be greatly appreciated, and I would be ever grateful for your kind assistance in this matter.
